TERMS AND CONDITIONS OF THE ONLINE STORE AND THE REGULATIONS FOR THE PROVISION OF ELECTRONIC SERVICES
These Terms and Conditions are valid from 1 January 2025
These Terms and Conditions define the rights and obligations of the Seller and the Customer related to the use of the website and online store available at https://pkp.edu.pl, including in particular:
- contracts for the provision of electronic services,
- rules for concluding sales contracts for products available in the online store,
- rules for concluding service contracts offered in the online store, in particular training and educational services, including beekeeping courses,
- rules for concluding contracts for the supply of digital content through the online store,
- and the rules and procedures for the consumer’s right of withdrawal.
With respect to services provided electronically, these Terms and Conditions constitute the Regulations referred to in Article 8(1)(1) of the Act of 18 July 2002 on Providing Services by Electronic Means.

For the purposes of these Terms and Conditions, the following terms shall have the meanings specified below:- Business Day – any day from Monday to Friday, excluding public holidays.
- Contact Form – an electronic service; a form available at https://pkp.edu.pl/kontakt/ to send inquiries to the Seller.
- Order Form – an electronic service; an interactive form in the Online Store enabling Customers to place an Order.
- Customer – a natural person with full legal capacity, a legal person, or an organizational unit without legal personality but possessing legal capacity, having residence or registered office in the Republic of Poland.
- Consumer – a Customer who is a natural person acting for purposes not directly related to their business or professional activity.
- Sole Trader (Entrepreneur with consumer rights) – a Customer who is a natural person concluding a contract with the Seller directly related to their business activity, where the contract is not of a professional nature for that entrepreneur.
- Civil Code – the Civil Code Act of 23 April 1964.
- Product – any movable item offered by the Seller within the Online Store.
- Electronic Product / Digital Content – digital content available in the Online Store as an electronic file (e.g., .doc or .pdf) subject to a Sales Contract between the Customer and the Seller.
- Services – all services provided by the Seller as part of its main business activity, including beekeeping courses and training.
- Electronic Service – a service provided electronically via the Online Store, in particular:
- providing access to the website and subpages at https://pkp.edu.pl/, including the Online Store,
- enabling Customers to create and manage an Account (Customer Account),
- sending commercial offers to consenting recipients (newsletter/subscription),
- enabling direct contact with the Seller via the contact form,
- Course – a beekeeping course organized by the Seller, held at the Seller’s apiary or another designated location, in accordance with the Course Regulations provided on the Store’s website or by e-mail before the course date.
- Regulations – these Terms and Conditions of the Online Store.
- Online Store / Store – the Seller’s online store available at https://pkp.edu.pl/
- Seller – Anna Konieczny-Bielak, 34-240 Toporzysko 256, NIP: 638 161 91 41; e-mail: mail@pkp.edu.pl
- Newsletter – an Electronic Service consisting of sending e-mails (HTML) containing commercial and other information related to the Seller’s business.
- Contract – a contract for services / electronic services / sale of a Product / supply of digital content, concluded via the Online Store.
- Consumer Rights Act – the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2020, item 287).
- Order – a declaration of will to purchase a product (including electronic) and/or services (including digital) via the Order Form.
§ 2. Preliminary Provisions
- Through the Website, the Seller sells Products, Electronic Products, and Services, and provides Electronic Services.
- These Terms define the rules of using the Website and the rights and obligations of the Seller and Customers.
- Minimum technical conditions:
- Internet access,
- a standard up-to-date operating system,
- a standard up-to-date browser (Opera, Firefox, Chrome, Safari) with cookies enabled,
- an active e-mail address.
- To use digital content, common software for DOC, PDF, MP4, MP3, MOV, AVI may be required; additional requirements are shown in the product description.
- If other technical conditions are required, the Seller will inform the Customer before the order is placed.
- Contracts cannot be concluded anonymously or under a pseudonym.
- The Customer shall not provide unlawful content and shall use the Website in compliance with the law, these Terms, and good practices, without disrupting the Store.
§ 3. General Information on Contracts and Placing Orders
- Depending on the selection:
- Products – sales contract,
- Electronic Products – contract for the supply of digital content,
- Services – service contract,
- Electronic Services – contract for electronic services.
- Mixed orders result in several contracts corresponding to the items ordered.
- The Store displays current offers with gross prices (PLN, incl. VAT):
- Product description – name, type, and legally required information (for food).
- Electronic Product description – name, content, access conditions.
- Service description – type, scope, performance date, conditions; beekeeping course conditions in a separate document; purchase implies acceptance.
- Store available 24/7; weekend/holiday orders processed next Business Day; possible technical downtime.
- Orders after logging in or as a guest; any special privileges for logged-in users are clearly indicated.
- Online payments via external operators.
- Payment methods:
- Electronic transfer – T-pay (Krajowy Integrator Płatności S.A.) with redirect to provider’s website,
- Bank transfer – after prior contact; shipping after the payment is credited.
- Payment immediately after placing the order unless the offer states otherwise.
- Purchase flow:
- select Products/Services → “add to cart”,
- provide required data (Customer, payment, delivery),
- review total price and costs,
- accept the Terms & confirm the order, then pay.
Confirmation is sent by e-mail.
- After the Contract is concluded, the Seller also sends its terms if not provided earlier.
- Order may be cancelled if data are incorrect despite request to correct, or if payment is not made within 7 Business Days.
- Order may be refused/cancelled if placed anonymously or using bots, crawlers, spiders, automated systems, or third-party services.
§ 4. Price
- Prices are gross (incl. taxes) unless explicitly stated otherwise.
- The Seller is a VAT taxpayer.
- Prices exclude delivery and other fees, which are shown before checkout.
- Reduced price – price after discount.
- Lowest price – the lowest price within 30 days before the discount (or since first offering if < 30 days).
- Prices/promotions may change; existing Contracts unaffected; promotions not combined unless stated.
- For perishable/short shelf-life goods, the price before the first discount is displayed next to the reduced price.
§ 5. Electronic Services
- Electronic services are provided via the Store.
- Core service – ability to place orders (no account required).
- Account – creation/maintenance; stores Customer data and order history (login via e-mail + password).
- Create account via “Create Account”; deletion on request (does not remove historical orders).
- Newsletter – e-mails about new products, promotions, services; subscribe via form/checkbox; unsubscribe via link or request.
- Contact Form – service enabling direct contact (required fields must be provided).
- E-services are free; sales/digital content/services (courses, education) are paid contracts.
- Appropriate technical/organizational security measures are applied.
- The Seller strives to ensure proper operation; Customers should report issues.
- Store operation complaints – by e-mail; processed within 14 days with e-mail reply.
§ 6. Services
- List of services (incl. beekeeping courses) on the Store’s website with dates, scope, and details.
- Course performance – sections 3 ff.; other services per the description in the Store.
- Order process for a course: add to cart → “Buy and Pay” (binding order and obligation to pay) → e-mail confirmation → contract upon receipt of confirmation.
- Course for another person: indicate participant within 7 days; change allowed up to 7 days before the course; deliver Course Regulations; safety note regarding bee venom allergy.
- Fulfilment: enabling participation on the date specified.
- Participation requires appearing at the course location on the scheduled date and accepting the Course Regulations.
- No-show (except valid withdrawal/termination by mutual consent) – no refund.
- Date change possible ≥14 days in advance if the Seller can offer another date; otherwise, consequences as in section 7.
§ 7. Products
- Add to cart → “Buy and Pay” (binding). E-mail confirmation after submission and payment. Contract upon order/shipping confirmation (separate message). Unavailability – notice by e-mail.
- Shipping after full payment incl. delivery costs. Methods/costs shown before payment.
- Orders fulfilled within Poland. Business days = Mon–Fri, excluding public holidays.
§ 8. Electronic Products
- Order: add to cart → “Buy and Pay” (binding). E-mail confirmation after submission and payment. Contract upon order/delivery confirmation.
- Access granted immediately after payment, no later than 48 hours unless stated otherwise.
- Delivery via Customer Account or as a file sent to the e-mail address.
- Access to social groups / live sessions – immediately or as per the offer.
- Access duration – limited or unlimited as specified in the offer.
- Technical issues – contact the Seller.
- Updates (incl. security) provided to maintain conformity.
§ 9. Right of Withdrawal from the Contract
- Consumer may withdraw within 14 days: from taking possession (Products) or from concluding the contract (digital content/Services).
- Exclusions:
- service fully performed with express consent and prior notice of withdrawal loss (e.g., attending a Course within 14 days),
- products:
- non-prefabricated, per Consumer specification or individualized needs,
- liable to deteriorate rapidly / short shelf life,
- sealed goods not suitable for return for health/hygiene reasons after opening (e.g., food jars once opened).
- digital content not on a tangible medium where performance began with express consent and notice of withdrawal loss (start = e-mail with access instructions).
- Withdrawal via an unambiguous statement (post/e-mail).

- Deadline met if notice is sent before the 14-day period expires.
- Return goods within 14 days of withdrawal (unless the Seller collects them); timely if dispatched before the deadline.
- Direct return costs borne by the Consumer.
- Refund may be withheld until goods are received or proof of dispatch is provided (whichever first).
- Digital content – cease use and do not share with third parties after withdrawal.
- Refund of all payments (incl. the lowest available shipping option) within 14 days; same payment method unless agreed otherwise; no fees.
- Consumer liable for diminished value due to handling beyond necessary verification.
- Sole proprietor (entrepreneur-consumer) – may withdraw under the same conditions when the contract is non-professional in nature.
§ 10. Complaints [Products, Digital Products, Services]
- Seller delivers goods/digital content free of defects and performs Services properly.
- Liability for defects / improper service performance.
- Report defects to the Seller with the related claim or statement.
- Complaint form: www.pkp.edu.pl/reklamacja/ (optional); e-mail: mail@pkp.edu.pl or registered post.
- Response without undue delay, within 14 days, to the Customer’s e-mail or another indicated channel.
- Seller’s liability towards entrepreneurs other than sole proprietors acting as consumers – excluded.
§ 11. Complaints [Electronic Services]
- Complaints by e-mail to mail@pkp.edu.pl or by registered post.
- Provide as much detail as possible (type/date of irregularity, contact).
- Review without undue delay, within 14 days.
- Response to the e-mail provided in the complaint or another chosen method.
§ 12. Copyright
- All materials (electronic products, texts, photos, graphics, multimedia, trademarks) are protected works.
- Copyrights are held by the Seller or licensors; other legal bases may apply.
- Materials for personal use only unless the offer states otherwise; no redistribution/sharing/copying/downloading.
- No copying, sharing, distributing, displaying, publishing beyond permitted use; no modification or resale of access rights.
- Breaches may result in blocked access without refund and claims in civil/criminal proceedings.
§ 13. Personal Data and Cookies
- Providing personal data is voluntary but necessary for contracts (products, digital content, Services, Electronic Services). Do not provide third-party data as your own.
- Data controller: the Seller.
- Purpose: contract performance via the Store.
- Account – data processed to establish/maintain the account.
- Newsletter – data processed to send newsletters.
- Contact – data processed for correspondence and archiving.
- The Store uses cookies.

§ 14. Out-of-Court Complaint and Redress Procedures
- The Seller agrees to mediation; details to be set by the parties.
- The Consumer may:
- apply to a permanent consumer arbitration court,
- request mediation from the provincial Trade Inspection authority,
- seek assistance from a local consumer ombudsman or consumer organization,
- use the ODR platform: ec.europa.eu/consumers/odr.

§ 15. Final Provisions
- Contracts are concluded in the Polish language.
- Polish law applies; competent courts are in Poland.
- The Seller may amend the Terms for important reasons:
- changes in law,
- rulings/decisions/guidelines of authorities,
- technical changes in e-service delivery,
- changes in the scope/terms of e-services (new/modified/withdrawn features),
- correction of ambiguities/errors/typos,
- changes in Seller identification/contact data,
- changes in payment/delivery methods,
- abuse prevention,
- improvement of Store operation and Customer service.
- Customers will be notified at least 14 days in advance via the Store and by e-mail.
- The Terms are available free of charge online, including archived versions.
